These terms and conditions are the responsibility of the DAM brand owned by Vogais Opacas Lda., with headquarters at Rua da Fundição 240, 3700-119 São João da Madeira, Portugal. The following Terms and Conditions apply to all business relations between the Company and the Private consumers who shop at www.shop.damportugal.com
We recommend that you read the terms of sale and delivery thoroughly before shopping at www.shop.damportugal.com (the “Webshop”).
1. Products, Materials and Finishings
1.1 Most of our products are made to order.
1.2 Our products are manufactured and handmade in Portugal. Each product is unique and may differ from each other, presenting small features typically seen on a handmade product. The final dimensions may vary slightly. Differences of colour and tonality can happen due to common changes in the natural materials, especially cork, wood, stone, rope and straw. So we cannot guarantee the uniformity of the colours and tonalities. These changes and differences are not considered defects.
1.3 Regarding products with cork, few cork granules may be released as time goes by due to its natural characteristics. These variations are not considered defects.
1.4 Although we have made a great effort to set colors and qualities as accurately as possible, we can not guarantee that your screen reproduces the color correctly due to differences in screen resolutions, etc. If you are in doubt about the color, we recommend you contact us by email or you visit our store in São João da Madeira, in Portugal.
1.5 The Private consumer who shops at our webshop accepts customary and reasonable variations in colour and/or dimensions of the goods, and are thus not considered as a defect.
1.6 Every lighting product includes bulbs and a European plug.
2. Customized products
2.1 Colours, dimensions or different finishings are possible at an additional cost and will be arranged with the client. Private customer can ask us for a customized product to webshop@damportugal.com
2.2 These Terms and Conditions are not applied to customized products.
3. Prices
3.1 At the Webshop, the stated prices are in Euros and include VAT (23%). Full payment is taken in advance and the card holder will be charged with the successful completion of the order.
3.2 The shipping costs depend on the delivery country. The delivery method is determined based on the size and weight of the items in your cart when proceeding the order.
3.3 Any return due to non-collection of your package at a post office or parcel delivery point, or if you are not present to receive your package at the agreed time, is at your own expense.
3.4 Cardboard packaging is always included in our prices; however, if the client requires specific packaging, the price will be charged accordingly.
4. Lead time
4.1 Our lead time is 2 to 8 weeks (excluding transport), depending on the product and after receipt of payment on adjudication.
4.2 If production delays or other delays occur in relation to the delivery, this could affect the delivery time. We strive to contact you as soon as possible in case of delays.
4.3 For large quantities DAM reserves the right to agree with the client the lead time.
5. Ordering products
5.1 You can order items online 24 hours a day. We handle orders weekdays Monday to Friday from 10 am – 5 pm (GMT+1). Orders placed outside this time period will be handled on the next working day.
5.2 You select the items you want to buy and put them in the “shopping cart”. You can correct the contents of the shopping basket right up to the time of ordering, and you can regularly check the contents and the price of the goods. You are responsible for ensuring that the customer information you enter as part of a purchase is correct.
5.3 When you place an order, the final agreement between you and DAM is only entered into when DAM by email sends an order confirmation, which confirms that the order is binding. You will receive a delivery notification by email when we ship your order from our warehouse.
5.4 You can cancel an order as long as the item has not started to be produced. Just contact us by email (webshop@damportugal.com) and we’ll cancel it and give you a full refund.
6. Payments
6.1 Payment for purchases in the Webshop can be made by the following means of payment: Visa, MasterCard and Paypal.
6.2 When shopping at our Webshop, DAM starts the production after the payment is 100% received and confirmed and the lead-time starts counting after this day.
6.3 All pieces are DAM’s property until the payment is 100% received and confirmed.
6.4 The final invoice is sent through email before delivery of the order.
6.5 We reserve the right, without prior notice, to discontinue any product, change its features and price.
7. Shipping & Delivery
7.1 On the Webshop, we sell to the countries that are part of the European Union. We deliver to these countries within three to five working days. The shipping costs depend on the delivery country. The delivery method is determined based on the size and weight of the items in your cart when proceeding the order.
7.2 If you want delivery to a country that does not appear during the order process, we ask you to contact us for a possible solution. In that case, we apply the general terms and conditions instead of the terms and conditions of the Webshop.
7.3 Our standard delivery provides you with a 24 hour, fully trackable service to your front door (Monday-Friday) from our delivery partners CTT, DPD, DHL, UPS and DSV depending on the size and weight of the items.
7.4 All our international orders through the Webshop are shipped according to the Incoterms® 2020 standards and typically travel by the Delivered At Door (DDP) term.
7.5 We strive to deliver your order as quickly as possible and the delivery time is stated on the product page. If your order contains products with different delivery times, your order will be delivered at the larger lead time.
7.6 If the packaging is damaged or bears other visible signs of defects, only acknowledge receipt on the consignment note subject to any damage to the contents or refrain from receiving the item and ask the driver to take it back.
7.7 Please be advised that the product(s) will require unpacking and inspecting for any faults or damage within 3 working days of receipt from DAM. Failure to do so may result in additional costs to replace the damaged item.
7.8 Missing items must be reported instantly to DAM through the email webshop@damportugal.com
8. Damages
8.1 All products are carefully packed up and inspected prior to shipment.
8.2 All our deliveries are covered by goods in transit insurance. However, the refusal of damaged goods in no way relieves the purchaser from the responsibility of paying the goods. In case of visible damage occurs in transit, the delivering carrier should be immediately notified with initial notification of intent to file a claim.
8.3 Damage of any item should be reported to DAM via email within 72 hours after delivery. Photographic evidence of the damage must be included in the email and sent to webshop@damportugal.com
8.4 We will then advise how to move forward with the return of your product(s) to DAM and all damaged goods will be replaced.
8.5 When sending any item back to us, it is important that you save all the original packaging. Please make sure it is packaged as it was when it arrived with you. If the packaging was damaged, extra packaging may be required. Customer services are on hand to give guidance on this.
8.6 If you need to return an item because it’s faulty, or because of something we’ve done wrong, we won’t charge you for the return/collection.
8.7 The delivery time of the replaced product will be arranged with the client.
8.8 All the damaged or missing products will be replaced, so money will never be refunded.
9. Returns
9.1 The right of withdrawal only applies to private consumers who shop at www.shop.damportugal.com.
9.2 Where an item is labelled “made to order” this means that this item will be made specifically for you by the supplier. We are unable to offer refunds or exchanges for made-to-order items. We apologise for any inconvenience this may cause, but rest assured, your item will be expertly crafted from the finest materials just for you.
9.3 No returns will be accepted without written consent from DAM. Unauthorised returns will be refused at the client’s expense.
10. Cleaning and Maintenance
10.1 Frequent dusting of your product will help you to maintain the lustre of varnish. Use a dry, soft cotton cloth.
10.2 Do not use abrasive detergent/cleaning products.
10.3 To protect the base of the product, verify if any surface can damage the base. Attaching felt pads to the bottom of the products can help to prevent scratches and dents as well.
10.4 Avoid contact with hot surfaces. It could leave marks which cannot be removed afterwards.
10.5 Avoid direct sunlight to keep the natural tonality of the natural materials.
11. Warranty
11.1 All DAM products are guaranteed for a period of 3 years. The warranty period begins on the date of delivery of the product to the location indicated by the buyer. It includes problems concerned with the production or material faults. During this time we will repair or replace the products.
11.2 The warranty excludes all damages caused by improper installation or usage, negligence or natural wearing out of the product.
11.3 No guarantee is provided on the customer’s own fabric.
11.4 In order to benefit from the warranty offered, it is necessary to report the defect to DAM via email. Photographic evidence of the defect must be included in the email and sent to webshop@damportugal.com
11.5 All defective goods will be replaced.
11.6 The delivery time for the replaced products will be arranged with the client.
11.7 Money will never be refunded.
12. Choice of law and venue
12.1 Purchases of goods at www.shop.damportugal.com are subject to Portuguese law. Any dispute is decided by the ordinary Portuguese courts.
